1) HOW TO ENTER: Complete and submit this online survey by the expiration date October 28, 2009. Final date to enter is October 28, 2009. Alternatively, you may enter the sweepstakes by mail by printing name, complete email address if available, street address, city, state, ZIP code, and telephone number on a 3 1/2" x 5" piece of paper, insert in an envelope and mail to: Saks Fifth Avenue OFF 5TH, 362 Ninth Avenue, 17th Floor, New York, NY 10001. This must be received by the expiration date. Limit one entry per household.
2) PRIZE: Two (2) prizes of one (1) $500 Saks Fifth Avenue OFF 5TH Gift Card will be awarded. United States federal, state and local taxes on prizes are the sole responsibility of the winner. No substitution or transfer of prizes permitted, except by Sponsor due to prize unavailability at time of award. Acceptance of the prize constitutes permission to use winner's name, photograph, and likeness for promotional purposes including, but not limited to, online posting without additional compensation. All other expenses association with use of the prize is the sole responsibility of the winner.
3) PRIZE DRAWING: Two winners will be selected in a random drawing to be conducted on or about one week after the expiration date by independent judges whose decisions are final on issues relating to this sweepstakes. The odds of winning depend upon the total number of eligible entries received. Judging will take place at Saks Fifth Avenue OFF 5TH offices in New York City. Winners will be notified using the email address provided during the survey within 5 business days of drawing date. If Sponsor is unable to contact potential winner(s) by email, or if any potential winner fails to respond to the prize notification within 5 days of issuance of notification, or if any winner fails to comply with any of the requirements, an alternate winner shall be selected through another random drawing conducted by judges. Allow 4-6 weeks after verification of winner status for the receipt of prize by mail.
4) ELIGIBILITY: This sweepstakes is open to persons who are 18 years of age or older at time of entry. This promotion is not open to employees of Saks Fifth Avenue, and its respective affiliates, licensees, franchisees, subsidiaries, advertising and promotion agencies and the immediate family members of each. By entering, participants without limitation, release and hold harmless Saks Fifth Avenue and its affiliates, licensees, franchisees, subsidiaries, advertising and promotion agencies from any and all liability for any injuries, loss or damage of any kind in connection with this sweepstakes or acceptance and use of a prize won. Void where prohibited. No responsibility is assumed by Sponsor, and entrants waive all claims for lost, late, illegible or misdirected surveys and mailed entries or for any problems of technical malfunction of any telephone network or lines, computer equipment, software, failure of any email service or any combination thereof including without limitation any damage to entrant's or any other person's computer resulting from participation in this promotion. Any attempt to damage the survey site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws.
5) WINNERS LIST: The name of the winner(s) will be posted on or about one month after the winner is selected on http://Customer-POV.com/OFF5TH_winners.htm. The notification will remain on the web site for 60 days.
6) NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Sweepstakes are hereby excluded, and any Entrant expressly waives any and all such rights and agrees that any and all disputes, claims, and causes of action arising out of or connection with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action. Entrants agree that these Official Rules are governed by the laws of the State of New York.
